Mr. Cicchirillo: Please
allow me to welcome you to your post as Commissioner of the
W.V.D.M.V. I hope the transition and new experiences go well for you
and your staff. In 2002-2003
I wrote several times to Mr. Pritt, then commissioner of the D.M.V.,
and spoke with department heads within the D.M.V. on the issue of
the new photo requirement stipulated by the D.M.V. which requires
the "fingerprint numbering" of a license-holder's face in
a statewide data base. Since then
problems concerning the computerized driver's license have
materially increased, strengthening my resolve and Christian
conviction not to accept the "modernized" driver's
license. You are
probably aware of the new requirement for a digitalized (numbered)
"fingerprint" photo now standard on all driver's licenses.
Because of my strongly held Christian convictions, that I share with
many thousands of law-abiding Christian Citizens, I
cannot accept this requirement. The computerized, digitalized
(numbered) print is the number of a man! In my case, my number. As
with all other individuals, their personal number. A numeralized
"map" of my personal uniqueness that is now shared
nationwide as a tracking identification device. It clearly violates
the Biblical teachings stated in the Book of Revelation, chapter
thirteen, verses sixteen through eighteen: "And he
calls us all, both small and great, rich and poor, free and bond, to
receive a mark in their right hand or in their foreheads: And that
no man might buy or sell, save he that hath the mark, or the name of
the beast, or the number of his name. Here is wisdom. Let him that
hath understanding, count the number of the beast. For it is the
number of a man: and his number is six hundred three score and
six." (KJV) I cannot
accept this abominable intrusion on my God-given personal uniqueness
and rights. In May 2005 the Real ID Act was signed into Federal Law,
and the situation deteriorated dramatically. My Scripturebased
convictions will not permit me to acquiesce in restriction of my
liberty. When I first corresponded with
the D.M.V., I was assured that the information on the driver's
license, including the digitalized number of my facial photo placed
into the database, would be seen by no person or government agency
outside the state of West Virginia. Over my protests of disbelief,
Mr. Pritt, head (and legal adviser) of the D.M.V., assured me,
wrongly, that my liberties were safe. Obviously, the man responsible
for the law's administration had misread it. As a Christian Pastor
and nationally syndicated talk show host, I have not the luxury of
making unconfirmed claims. I was sure that the civil servants were
misinformed. Sadly I could not convince them. Now with the Real ID
Act being law the Federal Government will decide what standards the
state-issued driver's license (National ID Card) must meet-in clear
violation of the Ninth and Tenth Amendments to the U. S.
Constitution. A further dangerous complication provided in the Real
ID Act allows the head of Homeland Security the sole discretion to
decide what additional requirements might be included, but not
limited to digitizing pictures, fingerprints, iris scans, and DNA.
Mr. Chertoff has with absolute impunity the unlawful authority to
detain, arrest, and confine anyone HE deems necessary. And the state
must comply with the Real ID Act by 2008. From that time we will no
longer be citizens; all our natural and civil rights will depend on
possession of what the Federal Government will accept as
identification. Myself and thousands of others
are being "forced" to encounter this Federal mandate
because the civil government has overstepped its lawful sphere of
authority! Followers of the Holy Scriptures sincerely desire to live
in compliance with civil laws where they do not oppose God's laws!
We cannot and will not surrender the gift of our God-given
"person" (personal uniqueness) to a worldwide computer
database system that leads inevitably to a world beast-controlled
tracking system! No free person can, or should
ever be expected to, violate his convictions and follow any
unconstitutional and ungodly mandate of men who neither know, nor
care to know, either the Holy Scriptures or the State and U. S.
Constitutions! I have clearly stated the
Scriptural grounds of this protest. To clarify the Constitutional
grounds please allow me to present decisions made by the U. S.
Supreme Court on the right to travel. No driver's license is
required. Case #1: "The use of the
highway for the purpose of travel and transportation is not a mere
privilege, but a common fundamental right of which the public and
individuals cannot rightfully be deprived." Chicago
Motor Coach v. Chicago, 169 NE 221 Case #2: "The right of the
citizen to travel upon the public highways and to transport his
property thereon, either by carriage or by automobile, is not a mere
privilege which a city may prohibit or permit at will, but a common
law right which he has under the right to life, liberty, and the
pursuit of happiness." Thompson v. Smith, 154 Case
#3: "The right to travel is part of the liberty of which the
citizen cannot be deprived without due process of law under the
Fifth Amendment. Kent v. Dulles, 357 US 116, 125 Case #4:
" The right to travel is a well-established common right that
does not owe its existence to the Federal Government. It is
recognized by the courts as a natural right." Schachtman v.
Dulles 96 App DC 287, 225 172d 938, at 941. We had this correspondence
hand-delivered because this issue is of utmost importance, as it has
affected, and will continue to affect, our rights to travel both for
pleasure and in pursuit of our need to earn a living. Myself and the
undersigned, plus many thousands more both state and nationwide as
honest citizens refuse continually to be tracked, traced, and
numbered by an agency of the government! We have all of our lives
conducted ourselves with integrity and without desire to harm.
Please KNOW for certain that we WILL NOT and CANNOT compromise on
this issue. I am
certain that you are as concerned as we. Please help us resolve this
matter as quickly as possible. We
