Two bills are now working their way through the legislature that should be of great concern to many - but especially the Christian Business Owner!

Passed the Senate today, Feb. 26th - Will be introduced in the House tomorrow and referred to the House Judiciary Committee.  Focus Calls on your Delegate, the Judiciary Chairman Webster, and the Governor.

SB 4132 the Captive Audience Bill
Passed the House on Monday. Was introduced in the Senate today- Feb. 26th. Referred to the Senate Judiciary Committee. At this time the committee is not expected to take up the bill until Thursday at 10 AM - But this could change.

Captive Audience Bill - Background - HB 4132 is now in the Senate!

The Captive Audience Bill, HB 4132, passed the Full House on Feb. 25th, 2008. A move is now expected this week in the WV State Senate to re-insert provisions that will make it illegal for an employer, and many in the work place, to share their faith in Christ.

Supporters of this effort are saying that their "intention" is to prevent workers from being forced to hear the religious views of the employer and his/her representatives by allowing workers to sue their employer if they feel "required" to hear the employer's religious views and "compelled" to believe what the employer is saying.

Taking God out of Private Business!
While some lawmakers may be well intentioned, this bill will for the first time allow an employer to be sued by the employee if he/she feels they are being required to hear the political or religious views of the employer and feels they are being compelled to agree with those views.

The employer might not know how the employee feels about what he is saying until he receives an order to go before a judge and explain his expression of faith in God, or before the State Labor Commissioner, who also will have the right to determine what is and is not religious speech.

The fine for illegally talking about God in the work place is higher than that given for many felony convictions.

It is not the "good intentions" of lawmakers that govern our lives, but the laws they create. This bill is an insult to Christian business owners. There already are  federal and state laws that protect workers from hostile work environments.

Talking Points:
  • Please protect my free speech rights by voting NO! to HB 4132, the
    Captive Audience Bill. Please put your energies into protecting my free speech rights, especially in the areas of political and religious speech
    - the foundational freedoms of America!
  • West Virginia does not need HB 4132. Workers are already protected from hostile work environments. Vote NO! to HB 4132, the Captive Audience Bill.

SB 600 would include sexual orientation as a protected or preferred class in The Human Rights Commission statute. This bill is in the House of Delegates!

Private businesses and landlords can get sued if they are not able to prove that they did not discriminate on the basis of sexual orientation.

Bill excerpt:
"...sexual orientation" means heterosexuality, bisexuality, homosexuality or gender identity or expression, whether actual or perceived."

In the case of an alleged act of discrimination by an employer, it would shift the burden of proof from the employee to the employer in demonstrating that discrimination did not take place.

It would do the same for those who rent property, whether in an apartment complex or a room in their private residence.

A New State Goal - Mandating acceptance of the homosexual lifestyle
The Human Rights Commission's purpose is to create acceptance and appreciation for the groups it seeks to protect. With the enactment of this legislation, it would begin to promote appreciation and acceptance on the basis of sexual orientation, such as those who are bisexual, homosexual, or transsexual in all places of public accommodation, including state government, private businesses, and public schools.

The purpose of this bill is to reshape the culture of West Virginia and encourage the acceptance and appreciation of the gay lifestyle.

While churches and non-profit groups seem to be excluded from this bill, it can be expected that in order to achieve its over-arching goal of preventing discrimination, religious organizations will eventually not be excluded from the human rights provisions.

Since the Supreme Court has already ruled that a non-profit, private institution can lose its tax-exempt status if it violates the spirit of the national policy against racial discrimination, why would this not eventually extend to sexual protection as well?

Call your Delegate and the Governor and ask them to oppose SB 600. Let them know that you do not want sexual orientation elevated to a protected class in the Human Rights Commission Statute!
