On this day, October 15, 1788, James Madison, who was called the
Father of the Constitution, commented on the role of the Supreme
Court:
"As the courts are generally the last in making the
decision, it results to them, by refusing or not refusing to
execute a law, to stamp it with its final character.
This makes the Judiciary department paramount in fact to the
Legislature, which was never intended, and can never be
proper."
Also on this day, October 15, 1991, the United States Senate, by
a vote 52-48, confirmed Clarence Thomas as a Justice on the
Supreme Court.
During the confirmation hearings, Senator Thurmond asked him a
question on judicial activism.
Clarence Thomas answered:
"The role of a judge is a limited one. It is to...interpret
the Constitution, where called upon, but at no point to impose
his or her will or his or her opinion in that process."
